Yes. Cannabis seeds are legal to purchase in New York for adults 21 and over. Under federal law (2018 Farm Bill), seeds with less than 0.3% THC are considered hemp and are legal nationwide. New York’s law (MRTA) allows adults to grow up to 6 plants per person at home, with a maximum of 12 plants per household. Importantly, only 3 of those plants per person can be mature (flowering) at any one time. The other 3 must be immature/vegetative. For example, a single adult could legally have 3 flowering plants and 3 in veg, while a household of two adults could have 6 flowering and 6 veg. These limits are designed for personal use. The home-grow regulations were finalized in 2024, meaning as of that year it became legal for adults to start cultivating their allotted plants at home. Always adhere to the plant counts – growing more than allowed can still get you in trouble. Also ensure your grow follows the state’s guidelines (e.g., not publicly visible and secured from unauthorized access).

Strains that finish relatively fast and resist humidity are generally best for New York’s climate. For outdoor growers, hardy classics like White Widow do great – White Widow is mold-resistant and can thrive even in humid East Coast summers. Other good outdoor choices are Blue Dream (vigorous and adaptable) and indicas like Northern Lights (known for toughness and quick finishing). Security is also a concern outdoors – make sure plants are not visible or accessible to the public. Indoors offers year-round growing and more control: you can produce multiple harvests a year in a tent or spare room, and you’re not worried about frost or nosy neighbors if you manage odor. Indoor growing is ideal for city dwellers without outdoor space – a small 2’x4’ tent can yield a surprising amount with the right lights and techniques. The trade-off is the upfront cost for equipment (lights, fans, filters) and higher electricity usage. Many New York growers actually do a bit of both: perhaps start seedlings indoors, move them outside for summer, and then also keep a few plants going indoors in winter. If you’re brand new and have space, starting indoors might be simpler because you won’t have to battle the elements.
